1. Acceptance of Terms

By accessing, browsing, or purchasing from www.pallets.cy (the “Website”), you (“User”, “Customer”, “Buyer”) agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our Website or services. Five Oceans Ltd reserves the right to update, modify, or replace these Terms and Conditions at any time without prior notice. Your continued use of the Website following any changes constitutes acceptance of those changes.

2. Company Information

The Website www.pallets.cy is fully owned and operated by Five Oceans Ltd, a registered corporate entity in the Republic of Cyprus. All contracts for the purchase of goods made through this Website are directly with Five Oceans Ltd.

3. Order Processing & Delivery Times

We strive to provide the fastest and most reliable logistics support in Cyprus. However, to maintain operational excellence, the following delivery terms apply to all purchases:

• Standard Target & Small Orders: While we actively aim to dispatch orders within 48 hours, our standard delivery timeframe for small or B2C orders across Cyprus is 3 to 7 business days.
• Bulk & B2B Orders: Large volume or commercial bulk orders are strictly subject to inventory confirmation. Upon submitting a request, our logistics team will confirm your order and provide a custom, guaranteed delivery timeframe tailored to your specific freight requirements.
• Force Majeure: Five Oceans Ltd shall not be held liable for any delay or failure in delivery caused by events outside our reasonable control, including but not limited to severe weather, strikes, port delays, or supply chain disruptions.

4. Risk and Transfer of Ownership

The risk of loss, damage, or destruction of the pallets transfers to the Customer immediately upon:

1. Delivery of the goods to the Customer’s specified address.
2. Loading of the goods onto the Customer’s (or a third-party courier’s) vehicle, in the event of a warehouse pickup. Ownership (title) of the goods remains with Five Oceans Ltd until full payment has been received and cleared.

5. Product Specifications & Used Goods

• New Pallets (EPAL/Export): Meet strict international and manufacturing standards.
• Used Pallets (DIY & Garden Grade): By purchasing “Used” or “Premium Used” pallets, the Customer acknowledges that these are second-hand industrial items. Wood color, wear, stamps, and minor imperfections will vary. Five Oceans Ltd explicitly disclaims liability for any aesthetic inconsistencies in used stock.
• Dimensions: All listed dimensions and weight capacities are subject to standard manufacturing tolerances.

6. Limitation of Liability (Disclaimer of Warranties)

To the maximum extent permitted by applicable law, Five Oceans Ltd provides the Website and products on an “as-is” basis.

• No Consequential Damages: Under no circumstances shall Five Oceans Ltd, its directors, employees, or affiliates be liable for any indirect, incidental, special, or consequential damages. This includes, but is not limited to, loss of profits, loss of goods during freight, supply chain interruptions, or customs delays arising from the use or inability to use our products.
• Improper Use: Five Oceans Ltd is not liable for any property damage, personal injury, or structural failure resulting from the overloading of pallets beyond their stated dynamic/static capacities, or from the improper upcycling, cutting, or modification of DIY pallets by the Customer.
• Maximum Liability: In any dispute, the total maximum liability of Five Oceans Ltd shall be strictly limited to the exact purchase price of the specific goods that gave rise to the claim.

7. Returns, Refunds, and Cancellations

• B2B / Commercial Orders: All bulk and B2B sales are final. Returns or refunds will only be authorized in the event that the delivered goods materially deviate from the agreed-upon specifications or are structurally defective upon arrival. Claims for defective goods must be made within 48 hours of delivery.
• B2C / Consumer Orders: In accordance with EU Consumer Rights Directives, private individuals (non-commercial buyers) maintain the right to return standard unused products within 14 days of receipt. The Customer is solely responsible for all return shipping costs to our Limassol warehouse.

8. User Submitted Data & Privacy

By submitting an inquiry, requesting a custom proposal, or placing an order, you agree to provide accurate and current information. The collection and use of this data (including Company Name, Email, and Phone Number) are governed by our Privacy Policy, strictly for the purpose of order fulfillment, logistics coordination, and customer service.

9. Intellectual Property

All content on www.pallets.cy, including but not limited to text, graphics, logos, images, digital downloads, and structural site design, is the exclusive property of Five Oceans Ltd and is protected by international copyright laws. Unauthorized scraping, copying, or commercial use of our content is strictly prohibited and will result in legal action.

10. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Cyprus. Any disputes, claims, or legal proceedings arising out of or relating to the use of the Website or the purchase of goods from Five Oceans Ltd shall be subject to the exclusive jurisdiction of the competent courts of Limassol, Cyprus.
